CALLER ID TERMS OF USE

Thank you for choosing Caller ID: Trusted Call & SMS. These Terms and Conditions ("Terms") govern your access to and use of our mobile application, website, and associated services (collectively, the "Service"). The Service is designed to assist you in managing incoming calls, identifying unknown numbers, and filtering potential spam or fraudulent communications.

By accessing, installing, registering with, or using any portion of the Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not accept or agree to these Terms in full, you are not authorized to access or use the Service, and you must discontinue all use immediately.

These Terms constitute a binding legal agreement between you ("User," "you," or "your") and the operator of the Service ("we," "us," or "our"). We recommend that you review them carefully before proceeding.

1. Dispute Resolution and Arbitration Agreement

By using the Caller ID: Trusted Call & SMS Service, you agree that any disputes, claims, or controversies arising out of or relating to these Terms, the Privacy Policy, or your use of the Service will be resolved in accordance with the dispute resolution process outlined herein. Where permitted by law, you acknowledge and agree that:

• Binding arbitration will be the primary means of dispute resolution, serving as an alternative to court proceedings,
• Arbitration will be conducted confidentially by a neutral third party, and
• You waive your right to a jury trial or to participate in a class action, unless prohibited by local law.

This clause materially affects your legal rights. We encourage you to read it carefully. If you do not consent to arbitration, your sole option is to discontinue use of the Service.

2. Conditions of Use

By accessing or using the Service, you agree to comply with the following:

• You will abide by the terms set forth in this Agreement in full;
• You will respect and be bound by our Privacy Policy, which forms an integral part of these Terms;
• You will adhere to any additional usage guidelines or feature-specific terms communicated to you at the time of use;

3. License Grant and Acceptable Use

Subject to your ongoing compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Caller ID: Trusted Call & SMS Service solely for your personal, non-commercial use on compatible devices that you own or control.

A. Prohibited Uses

This license does not permit you to:

• Copy, reproduce, or adapt any part of the app's software, source code, or design elements;
• Modify, decompile, disassemble, or reverse-engineer any portion of the application or attempt to extract its source code;
• Create derivative works or unauthorized variations based on the Service;
• Distribute, sublicense, lease, or make the Service available to third parties in any form;
• Use any of our trademarks, service marks, branding, or visual identity elements without express written permission.

Any unauthorized use constitutes a material breach of these Terms and may result in immediate suspension or termination of your access, in addition to legal action.

B. Third-Party Integration

If you intend to integrate our Service, or any part thereof, into another product, software, platform, or application, you must first obtain a separate, written commercial license agreement from us. Unauthorized integration or redistribution is strictly prohibited.

4.Eligibility and Age Restrictions

Access to the Caller ID: Trusted Call & SMS Service is restricted to individuals who meet the following eligibility criteria:

A. Minimum Age Requirement

• You must be at least 13 years of age to register for, access, or use the Service.
• If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you may only use the Service under the supervision and with the verifiable consent of a parent or legal guardian.
• Where applicable law requires a higher minimum age for lawful use of the Service without parental consent, that higher age will apply.

B. Enforcement of Age Compliance

We take age-related access restrictions seriously. If we become aware that a user under the required age has accessed the Service without appropriate consent or in violation of these Terms:

• We will take immediate steps to suspend or permanently terminate the associated account, and
• We may delete any personal data collected in violation of applicable child data protection laws.

By using the Service, you represent and warrant that you meet the applicable age requirements and are fully able and competent to agree to and abide by these Terms.

5.Intellectual Property Rights

All components of the Caller ID: Trusted Call & SMS Service—including but not limited to the application software, user interface, design elements, text, graphics, logos, trademarks, service marks, code, databases, and related technologies—are the exclusive property of the Company and/or its authorized licensors or partners.

These assets are protected by applicable laws, including but not limited to intellectual property statutes governing copyrights, trademarks, trade secrets, patents, and other proprietary rights.

A. Ownership and Reservation of Rights

Except as expressly provided in these Terms, all rights, title, and interest in and to the Service and its content remain the sole and exclusive property of the Company. No part of the Service may be construed as conferring any license or right to use our intellectual property without prior written authorization.

B. Limited License for Use

Subject to your continued compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only. This license is limited in scope and duration and may be suspended or revoked at any time for violation of these Terms.

C. Prohibited Actions

You may not, directly or indirectly:

• Reproduce, modify, adapt, translate, publish, or distribute any part of the Service or its content;
• Create derivative works or perform reverse engineering, decomplication, or disassembly of the Service;
• Sell, license, rent, lease, or otherwise commercialize any feature or element of the Service;

D. No Transfer of Ownership

Use of the Service does not grant you any ownership interest, title, or intellectual property rights other than the limited rights explicitly granted under this Agreement.

E. Enforcement and Remedies

We reserve the right to pursue legal remedies, including civil or criminal action, in the event of any unauthorized use, infringement, or misappropriation of our intellectual property.

6. Access to and Use of the Service

A. Grant of Access

Subject to your adherence to these Terms, we grant you a personal, non-exclusive, non-transferable, and revocable right to access and use the Caller ID: Trusted Call & SMS Service strictly for personal, non-commercial purposes. This access is provided "as-is" and "as available" and is conditional upon your compliance with all applicable laws and these Terms.

B. Permitted Use

You may access and utilize the features and functionalities of the Service only in ways that are expressly permitted under this Agreement. You may not use our trademarks, copyrighted materials, service marks, or any proprietary assets without prior written authorization.

All usage must:

• Be lawful,
• Not infringe upon the rights of others, and
• Not violate our acceptable use policies, which may be updated from time to time.

C. Suspension or Termination of Access

We reserve the right, at our sole discretion, to suspend, restrict, or permanently revoke your access to the Service, in whole or in part, with or without prior notice, under the following conditions:

• If you breach any provision of these Terms,
• If you misuse or attempt to interfere with the integrity or functionality of the Service,
• If required by law, regulation, or legal process.

D. Consequences of Termination

If your access is terminated for any reason:

• Your license to use the Service shall immediately cease,
• You must discontinue all use of the application and any related services,
• Any features, data, or access privileges granted to you will be revoked without liability or obligation on our part.

We are not liable for any damages, losses, or inconvenience resulting from the suspension or termination of your access.

7. User-Provided Content and Data Responsibilities

When using the Caller ID: Trusted Call & SMS Service, you may submit, upload, or otherwise provide certain types of content or personal data, either directly (e.g., profile details, contact lists) or indirectly (e.g., through call interactions, app usage, or device-related data). The following provisions apply to all user-contributed content and information:

A. Accuracy and Authorization

• You are solely responsible for the accuracy, legality, and appropriateness of any information or content you provide through the Service.
• You represent and warrant that:
  • You have all necessary rights, permissions, and consents to share such content;
  • Your content does not violate any third party's privacy, intellectual property, or contractual rights;
  • Your content will not disrupt, interfere with, or degrade the Service for others.

B. Collection of Technical and Usage Data

We may collect non-personal and device-related data, such as geolocation, app usage statistics, mobile identifiers, and crash logs, to enhance app functionality, maintain performance, and support diagnostics. All such processing is governed by our Privacy Policy, which forms an integral part of these Terms.

C. Sharing Third-Party Information (Contacts, Recordings, etc.)

• If you share contact information or personal data related to third parties (e.g., from your address book), you are responsible for ensuring you have the legal right to share such information and that it is accurate.
• If you enable features such, as call recording, you must comply with all applicable local, state, or international laws requiring notification or consent from the other party. It is your responsibility to:
  • Inform other parties where legally required,
  • Obtain their consent prior to recording,
  • Refrain from using recordings for any unlawful or harmful purpose.

Note: Call recordings are stored only on your local device and are not uploaded to our servers. We disclaim any liability arising from your use of this feature.

D. License to Use Your Content

By submitting or uploading any content to the Service (such as feedback, text, data, or shared material), you grant us a non-exclusive, royalty-free, worldwide, irrevocable license to:

• Use, reproduce, modify, adapt, publish, display, and distribute such content,
• Incorporate it into other materials or services for operational, analytical, or marketing purposes.

This license remains in effect even if you discontinue use of the Service.

E. Monitoring and Content Disclaimer

While we reserve the right to monitor, moderate, or remove user-generated content, we do not guarantee its accuracy, reliability, or legal compliance. You acknowledge that:

• You may be exposed to content that is outdated, misleading, or objectionable,
• You accept all risks associated with accessing or relying on third-party content available through the Service,

We assume no liability for user-submitted content or any harm resulting from your reliance on it.

We are not liable for any acts, omissions, or failures of third-party providers.

9. Service Availability and Disclaimer

The Caller ID: Trusted Call & SMS Service is provided on an "as is" and "as available" basis without warranties of any kind—either express or implied. By using the Service, you acknowledge and agree that:

• We do not guarantee uninterrupted access, real-time performance, or that the Service will be error-free or secure at all times;
• We make no representations regarding the accuracy, completeness, or timeliness of any information presented, including but not limited to caller names, phone numbers, spam ratings, or contact details;
• The Service may be periodically updated, modified, or temporarily unavailable for maintenance, upgrades, or due to unforeseen disruptions.

We expressly disclaim liability for:

• Any loss or damage resulting from reliance on inaccurate or incomplete caller identification,
• Device malfunction, data corruption, or software conflicts arising from use of the app.

10. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them—including non-contractual disputes—shall be governed by and interpreted in accordance with the laws of India.

You agree that any legal action or proceeding arising under these Terms shall be exclusively subject to the jurisdiction of the competent courts located in New Delhi, India, and you irrevocably consent to such jurisdiction.

11. Business Transfers

In the event that our business or the Service is merged with, acquired by, or transferred to another entity (whether partially or entirely), we reserve the right to assign or transfer our rights and obligations under these Terms.

• You will be notified of any such change in ownership or control.
• The new entity will assume all responsibilities outlined in these Terms.
• You may not assign or transfer your rights under this agreement without our prior written consent.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, directors, employees, licensors, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected to:

B. User Assumption of Risk

You expressly understand and agree that:

• The Service is provided on an "as is" and "as available" basis without any warranties;
• We do not guarantee the accuracy, completeness, or timeliness of any caller ID or contact information provided through the app.

C. Exclusive Remedy

If you are dissatisfied with the Service or these Terms, your sole and exclusive remedy is to discontinue use of the Service and uninstall the application from your device. We are not obligated to provide compensation or alternative solutions beyond this remedy.

D. Statutory Rights and Non-Excludable Liability

Nothing in these Terms shall operate to:

• Exclude or limit liability for death or personal injury caused by our negligence;
• Limit rights granted to you under applicable consumer protection laws;
• Exclude liability where such limitation is prohibited by law.

In jurisdictions where certain exclusions are not permitted, our liability shall be limited to the minimum extent required by applicable law.

14. Advertisements and Promotional Content

The Caller ID: Trusted Call & SMS Service may display third-party advertisements, sponsored content, or promotional offers as part of its user experience. These advertisements may appear in various formats within the app or during its usage.

A. Third-Party Advertisers

• Advertisements displayed within the Service may originate from third-party advertising networks or partners.
• By interacting with these ads (e.g., clicking or viewing), you may be redirected to external websites or presented with promotional content or offers.
• We do not control the content, accuracy, or privacy practices of third-party advertisers, nor do we endorse any products or services promoted through such ads.

B. User Assumption of Risk

Engaging with advertisements or promotional materials is done at your own risk . We disclaim all liability for:

• Third-party website content or offers,
• Any resulting transactions or outcomes,
• Data practices of external advertisers.

We encourage you to review the terms and privacy policies of any third-party entities before interacting with their content.

15. Changes to These Terms

We reserve the right to amend, revise, or update these Terms of Service at any time. When changes are made:

• The updated version will be published within the Service, including a revised "Last Updated" date;
• Material changes may also be communicated via in-app notifications or other reasonable means.

By continuing to use the Service after such changes take effect, you acknowledge and agree to be bound by the updated Terms. If you do not agree with the modifications, you must discontinue use of the Service.
